ಇಡೀ ದೇಶವನ್ನೇ ಬೆಚ್ಚಿ ಬೀಳಿಸಿದ್ದ, ಮಹಿಳೆಯರು, ವಿದ್ಯಾರ್ಥಿನಿಯರನ್ನು ಇನ್ನಿಲ್ಲದ ಆತಂಕಕ್ಕೀಡು ಮಾಡಿದ್ದ ಸಂದರ್ಭ ದೆಹಲಿಗ್ಯಾಂಗ್ ರೇಪ್. ಡಿಸೆಂಬರ್ 16. 2012ರಂದು ದೆಹಲಿಯಲ್ಲಿ ಚಲಿಸುತ್ತಿದ್ದ ಬಸ್ಸಿನಲ್ಲಿ ಪ್ಯಾರಾಮೆಡಿಕಲ್ ವಿದ್ಯರ್ಥಿನಿ ಮೇಲೆ 6 ಜನರ ಗುಂಪೊಂದು ಸಾಮೂಹಿಕ ಅತ್ಯಾಚಾರ ನಡೆಸಿತ್ತು. ತೀವ್ರವಾಗಿ ಹಲ್ಲೆಗೊಳಗಾಗಿದ್ದ ಯುವತಿ ಸಿಂಗಾಪುರ್ ಆಸ್ಪತ್ರೆಯಲ್ಲಿ ಸಾವನ್ನಪ್ಪಿದ್ದಳು. ಈ ದುರ್ಘಟನೆ ಎಲ್ಲರ ಮನದಲ್ಲೂ ಅಚ್ಚಳಿಯದೇ ಉಳಿದಿದೆ.

ಘಟನೆಯನ್ನು ಖಂಡಿಸಿ ದೇಶದ ಮೂಲೆ ಮೂಲೆಗಳಲ್ಲಿ ಪ್ರತಿಭಟನೆಗಳು ಭುಗಿಲೆದ್ದಿದ್ದವು, ಒಕ್ಕೋರಲ ಆಕ್ರೋಶಗಳು ವ್ಯಕ್ತವಾಗಿದ್ದವು. ಅಪರಾಧಿಗಳಿಗೆ ಅತ್ಯಂತ ಕಠಿಣ ಶಿಕ್ಷೆಯನ್ನು ವಿಧಿಸಬೇಕು ಎಂಬ ಕೂಗು ಎಲ್ಲೆಡೆ ಕೇಳಿ ಬಂದಿತ್ತು. ಈ ಪ್ರಕರಣ ನಡೆದ ಬಳಿಕ ದೇಶದ ಹಲವೆಡೆಗಳಲ್ಲಿ ರೇಪ್, ಗ್ಯಾಂಗ್ ರೇಪ್, ಮಹಿಳಾ ದೌರ್ಜನ್ಯದಂತಹ ಪ್ರಕರಣಗಳು ತೀವ್ರರೀತಿಯಲ್ಲಿ ಬೆಳಕಿಗೆ ಬಂದವು, ಬರುತ್ತಲೂ ಇದೆ. ಅಂದಿನಿಂದ ಇಂದಿನವರೆಗೆ ಮಹಿಳೆಯರು, ಯುವತಿಯರು ಜೀವ ಕೈಯಲ್ಲಿ ಹಿಡಿದು, ಕ್ಷಣ, ಕ್ಷಣಕ್ಕೂ ಆತಂಕದಲ್ಲಿ ಬದುಕಬೇಕಾದ ಸ್ಥಿತಿ ದೇಶದಲ್ಲಿ ಎದುರಾಗುತ್ತಿದೆ. ಮಹಿಳೆಯರಿಗೆ ದೇಶದಲ್ಲಿ ಭದ್ರತೆ ಇಲ್ಲ ಎಂಬ ರೋಷಾವೇಷ ವ್ಯಕ್ತವಾಗುತ್ತಲೇ ಇದೆ. ಈ ಬಗ್ಗೆ ಪ್ರತಿಭಟನೆಗಳೂ ವ್ಯಕ್ತವಾಗುತ್ತಲೇ ಇದೆ. ವಿಪರ್ಯಾಸವೆಂದರೆ ಈ ರೋಷಾವೇಷ, ಪ್ರತಿಭಟನೆಗಳ ಬಿಸಿ ಆಗಾಗ ಎದ್ದು, ಮತ್ತೆ ತಣ್ಣಗಾಗುತ್ತಲೂ ಇದೆ.

ಆದರೆ ಈಗ ವಿಷಯವೇನೆಂದರೇ,,,,,

ದೇಶವನ್ನೇ ತಲ್ಲಣಗೊಳಿಸಿದ್ದ ದೆಹಲಿ ಗ್ಯಾಂಗ್ ರೇಪ್ ಪ್ರಕರಣದ ಮೊದಲ ತೀರ್ಪು ಹೊರಬಿದ್ದಿದೆ.. ಅದು ಘಟನೆ ನಡೆದು, ಅಮಾನುಷವಾಗಿ ಹಲ್ಲೆಗೊಳಗಾದ ಯುವತಿ ಸಾವು-ಬದುಕಿನ ನಡುವೆ ಹೋರಾಟ ನಡೆಸಿ, ಕೊನೆಯುಸಿರೆಳದ ಸುಮಾರು 8 ತಿಂಗಳುಗಳಾದ ಬಳಿಕ.... ಇರಲಿ ಅಂತೂ ಅಪರಾಧಿಗೆ ಶಿಕ್ಷೆ ಪ್ರಕಟವಾಯಿತಲ್ಲ ಅಂತ ಅಂದುಕೊಂಡು ನಿಟ್ಟಿಸಿರು ಬಿಡುವಂತಿಲ್ಲ, ಬದಲಾಗಿ ಹಾಗೇ ಕಟ್ಟಿಕೊಂಡ ನಿಟ್ಟುಸಿರು ಅಲ್ಲೇ ಉಡಿಗಿಹೋಗುವಂತಿದೆ ಪ್ರಕರಣದ ತೀರ್ಪು....! ಅಪರಾಧಿಗೆ ನೀಡಿದ ಶಿಕ್ಷೆಯಾದರೂ ಎಂಥ್ದ್ದು....? ಅತ್ಯಾಚಾರಕ್ಕೊಳಗಾಗಿ ಸಾವನ್ನಪ್ಪಿದ ಯುವತಿ, ಆಕೆಯ ಪೋಷಕರಿಗೆ ಸಿಕ್ಕ ನ್ಯಾಯವಾದರು ಏನು...? ಬರಿ 3 ವರ್ಷ ಶಿಕ್ಷೆ.

ಈ ಪ್ರಕರಣದ ಪ್ರಮುಖ ಆರೋಪಿಯೊಬ್ಬ ಅಪ್ರಾಪ್ತವಯಸ್ಕ.... ಬಾಲಾಪರಾಧಿ.... ಬಾಲ ನ್ಯಾಯ ಮಂಡಳಿ ಆತನಿಗೆ ನೀಡಿದ ಶಿಕ್ಷೆಯ ಪ್ರಮಾಣ 3 ವರ್ಷ.. ಯುವತಿಯ ಮೇಲೆ ಗ್ಯಾಂಗ್ ರೇಪ್ ನಡೆಸಿದ ವೇಳೆ ಈತ ಉಳಿದ ಅಪರಾಧಿಗಳಿಗಿಂತ ಅತ್ಯಂತ ಕ್ರೂರವಾಗಿ, ಹೇಯವಾಗಿ ವರ್ತಿಸಿದ್ದ. ಅಂತಹ ಕ್ರೂರ, ಅಮಾನುಷ ಕೃತ್ಯವೆಸಗಿದ ಅಪರಾಧಿಯೊಬ್ಬನಿಗೆ ನೀಡಿದ ಶಿಕ್ಷೆ ಕೇವಲ 3 ವರ್ಷ ಮಾತ್ರ.... ಆತಗೈದ ದುಷ್ಕೃತ್ಯಕ್ಕೆ ಇಷ್ಟೇನಾ ಶಿಕ್ಷೆ...? ಆದ ಅನ್ಯಾಯಕ್ಕೆ ಇದೇನಾ ಸಿಕ್ಕ ನ್ಯಾಯ....? ಎಂಬ ಪ್ರಶ್ನೆ ಎಲ್ಲರಲ್ಲಿ ಮನೆಮಾಡಿದೆ. ಎಂತಾ ದುಸ್ಥಿತಿ.....

ಇಷ್ಟು ದಿನಗಳ ಕಾಲ ಅಪರಾಧಿಗೆ ಕಠಿಣ ಶಿಕ್ಷೆ ಲಭ್ಯವಾಗತ್ತುದೆ ಎಂದು ತುದಿಗಾಗಲ್ಲಿ ಕಾದು, ನಿರೀಕ್ಷೆಯಲ್ಲಿದ್ದವರಿಗೆ ಇದಕ್ಕಿಂತ ಆಘಾತ ಬೇಕಾ.....? ಅಲ್ಲಾ, ಇದೂ ಒಂದು ಶಿಕ್ಷೆನಾ...... ಇದು ನಮ್ಮ ದೇಶದ ಕಾನೂನು ವ್ಯವಸ್ಥೆ... ನಿಜಕ್ಕೂ ನಾಚಿಕೆಗೇಡಿನ ಸಂಗತಿ..... ಎಂತವರಿಗಾದರೂ ಇದಕ್ಕಿಂತ ದುಸ್ಥಿತಿ ಇದೆಯಾ ಅನ್ನಸದಿರದು.... ಅಷ್ಟು ದಿನಗಳಿಂದ ರೊಚ್ಚಿಗೆದ್ದು ಭುಗಿಲೆದ್ದ ಪ್ರತಿಭಟನೆ, ಆಕ್ರೋಶಗಳ ಬೆಂಕಿಗೆ ಉರಿವಷ್ಟು ಉರಿದ ಮೇಲೆ ನೀರೆಚಿದಂತಾದ ಸ್ಥಿತಿ....... ಯಾವ ಶಬ್ದಗಳಿಂದಲೂ ಹೇಳಲಾಗದ ದುಸ್ಥಿತಿ..

ಬಾಲಾಪರಾಧಿಗೆ 3 ವರ್ಷ ಜೈಲು ಶಿಕ್ಷೆಯೇನೋ ಪ್ರಕಟವಾಗಿದೆ. ಆದರೆ ಈಗಾಗಲೆ ಬಾಲಾಪರಧಿ 8 ತಿಂಗಳ ಜೈಲುವಾಸ ಅನುಭವಿಸಿದ್ದಾನೆ. ಹಾಗಾಗಿ ಇನ್ನು 2 ವರ್ಷದ 4 ತಿಂಗಳ ಶಿಕ್ಷೆ ಮಾತ್ರ ಆತನಿಗೆ ಬಾಕಿ ಇದೆ. ಇನ್ನೊಂದು ವಿಚಾರ ಅಂದ್ರೆ ಆತ ಒಬ್ಬ ಅಪ್ರಾಪ್ತ ಹಾಗಾಗಿ ಆತನನ್ನು ’ಆರೋಪಿ’ಎಂದಾಗಲಿ, ’ಅಪರಾಧಿ’ ಎಂದಾಗಲಿ ಹೇಳುವಂತಿಲ್ಲ. ಮಕ್ಕಳ ಹಕ್ಕುಗಳ ಆಯೋಗದ ಪ್ರಕಾರ ಆತ ಕಾನೂನಿನ ಸಂಘರ್ಷಕ್ಕೊಳಗಾದ’ಮಗು’ ಎಂದು ಸಂಬೋಧಿಸಬೇಕಂತೆ.... ನೋಡಿ ನಮ್ಮ ವ್ಯವಸ್ಥೆ...

ಇನ್ನೊಂದು ವಿಪರ್ಯಾಸ ಅಂದ್ರೆ ಅಪ್ರಾಪ್ತ ಅವಯಸ್ಸಿನವರು ಇಂತಹ ಕೃತ್ಯ ನಡೆಸುವಾಗ ಅವರು ಸ್ವಚ್ಛೆಯಿಂದ ಮಾಡುವುದಿಲ್ಲವಂತೆ. ಅವರು ಯಾವುದೋ ಸಂದರ್ಭಕ್ಕೆ ಸಿಕ್ಕಿ, ಇಲ್ಲ ಸ್ನೇಹಿತರ ಒತ್ತಡಕ್ಕೆ ಸಿಕ್ಕಿ, ಗುಂಪಲ್ಲಿ ಗೋವಿಂದಾ ಎಂಬಂತೆ ಮಾಡುತ್ತಾರೆ ಎಂಬುದು ಮನೋವಿಜ್ನಾನಿಗಳ ಹೇಳಿಕೆ. ಇದು ನೋಡಿ ಎಂತಾ ದುರಂತ....

ಇಷ್ಟಕ್ಕೂ ಆ ಕಾನೂನಿನ ಸಂಘರ್ಷಕ್ಕೊಳಗಾದ’ಮಗು’ಗೆ ಎಲ್ಲಾ ಅಪರಾಧಿಗಳಿಗಳಂತೆ ಜೈಲಿನಲ್ಲಿ ಶಿಕ್ಷೆಯಾಗದು, ಆತನನ್ನು ಸುಧಾರಣಾ ಗ್ರಹದಲ್ಲಿಟ್ಟು, ಉತ್ತಮ ನಾಗರಿಕನನ್ನಾಗಿ ಮಾಡಲು ತಿದ್ದುವ ಪ್ರಯತ್ನ ನಡೆಸಲಾಗುತ್ತದೆ.

ಅಪ್ರಾಪ್ತ ವಯಸ್ಸು ಅಂದರೆ, ಹೋಗ್ಲಿ ಏನೋ ತಪ್ಪು ಮಾಡ್ಬಿಟ್ಟ ದೊಡ್ದೋನ್ ಆದ್ಮೇಲೆ ತಿದ್ಕೋತಾನೆ ಅಂತ ಅಂದ್ಕೊಳ್ಳೋಕೆ ಆ ಮಗು ಛೀ, ಆ ಪಾಪಿ ಮಾಡಿದ್ದು, ಸಣ್ಣ ಪುಟ್ಟ ತಪ್ಪಾ... ಇಲ್ಲಾ ಆ ಯುವತಿಗೆ, ಆಕೆಯ ಪೋಷಕರಿಗೆ ಆದ ಅನ್ಯಾಯ, ಆಘಾತ ಸರಿಪಡಿಸುವಂತಾ ಕೆಲಸಾನಾ.... ಅಥವಾ ಅಪರಾಧಿಗೆ ತಾನು ಮಾಡುತ್ತಿರುವುದು, ಮಾಡಿದ್ದು ಒಂದು ನೀಚ ಕೆಲಸ ಎಂಬುದೂ ಅರಿವಾಗದಂತಹ ವಯಸ್ಸಾ.... ಖಂಡಿತಾ ಇಲ್ಲಾ... ಅಂದ್ಮೇಲೆ ಅಪರಾಧಿ ಏನೇ ಆಗಿರಲಿ ಅಪರಾಧ ಅಪರಾಧವೆ ಎಂದು ಪರಿಗಣಿಸಬೇಕಿತ್ತು. ಬಾಲಾಪರಾಧಿಗೆ ಊಹಿಸೋಕು ಆಗದ ಕಠಿಣೆ ಶಿಕ್ಷೆಯಾಗಬೇಕಿತ್ತು. ಆ ಶಿಕ್ಷೆ ಇನ್ನೊಂದು ಅಪರಾಧಿಗೆ ಪಾಠವಾಗಬೇಕಿತ್ತು.

ಆದರೆ ಈಗ ನೀಡಿದ ತೀರ್ಪು ಅಂತಹ ಅಪರಾಧಿ ಪ್ರೌವೃತ್ತಿಯ ಮನಸ್ಸಿನವರಿಗೆ ಓ.., ಬರಿ 3 ವರ್ಷ ಜೈಲು, ಅದಾದ ಮೇಲೆ ಬಿಟ್ಬಿಡ್ತಾರೆ ಅಷ್ಟೇ.. ಎನ್ನುವ ತಪ್ಪು ಸಂದೇಶ ರವಾನಿಸಿದಂತಾಗುತ್ತದೆ. ಎನೇ ಇದ್ದರೂ ಅಪರಾಧಿ ಅಪರಾಧಿನೆ. ಆತ ಅಪ್ರಾಪ್ತನೋ, ಪ್ರಾಪ್ತನೋ ಒಟ್ಟಿನಲ್ಲಿ ಆತ ಗೈದ ನೀಚ ಕೃತ್ಯಕ್ಕೆ ಮರಣದಂಡನೆಯೋ ಇಲ್ಲ ಜೀವನಪರ್ಯಂತ ಅನುಭವಿಸುವಂತಹ ಶಿಕ್ಷೆಯನ್ನೋ ನೀಡಿದರೆ ನಮ್ಮ ಸಮಾಜದಲ್ಲಿ ಮಹಿಳೆಯರ ಮೆಲಿನ ದೌರ್ಜನ್ಯ, ರೇಪ್ ನಂತಹ ದುರ್ಘಟನೆಗಳು ಕಡಿಮೆಯಾಗುತ್ತದೆ. ಇನೊಬ್ಬ ವ್ಯಕ್ತಿ ಇಂತಹ ಕೃತ್ಯಕ್ಕೆ ಇಳಿಯುವಾಗ ಯೋಚಿಸುತ್ತಾನೆ ಮಾತ್ರವಲ್ಲ ಅಂತವರ ಮನಸ್ಥಿತಿ ತನ್ನಿಂದ ತಾನೇ ಬದಲಾಗುತ್ತದೆ.
